Access to sales on the site " wa-mono.com "Implies without reservation the acceptance of the following provisions.

 

Preamble

These general conditions of sale apply exclusively between Wa-mono and any person visiting the site, or making a purchase via the " wa-mono.com  ».

Any Internet user acknowledges having read the general conditions of sale on the site " wa-mono.com  And expressly accepts these conditions by purchasing the products online. 

These general conditions of sale may be subject to modifications, the conditions applicable are those in force on this site, on the date of placing the order.

  Article 1 - General

These general conditions of sale define the rights and obligations of the parties in connection with the sale of products by Wa-Mono to its customers via the website " http://wa-mono.com ».
The customer declares to have read it and to accept the rights and obligations relating thereto.

 

Article 2 - Definitions

  • The customer: Any natural or legal person who wishes to purchase a product offered for sale online by Wa-Mono.
  • Products: Products sold by Wa-Mono, in stock or made to measure, on customer order.

 

Article 3 - Customer identification

Before placing the order, the customer must complete an online form, which contains information necessary for his identification. This is essential for the processing and delivery of orders, the preparation of invoices and warranty contracts. Failure to provide information results in the non-validation of the order.

To order a product online, the customer must be uniquely identified by means of a username and password that he provides himself.

The customer assumes full responsibility for the use of his identifiers and therefore for orders placed using them.

Indeed, the information given by the customer commits the latter: in the event of an error in the wording of the contact details of the recipient of the product, Wa-Mono cannot be held responsible for the impossibility in which it could be to deliver the product. .

 

Article 4 - Product characteristics and conformity

4.1. The characteristics, qualities, price of the products offered for sale online are the responsibility of Wa-Mono. The photographs illustrating the products or services on the site are not contractual. Complaints should therefore be addressed to Wa-Mono.
 
4.2 In any case, these provisions do not deprive the customer of the benefit of his right of withdrawal, as framed by Article 11 of these General Conditions of Sale.

 

Article 5 - Product availability

In the event of total product unavailability after placing the order, the customer will be informed by Wa-Mono within 2 working days, by email of the postponement of delivery of the order or of its cancellation. Pursuant to the provisions of Article L 121-20-3 of the Consumer Code, in the event of unavailability of the product, the customer then has the option:
  • Or to be delivered of a product of equivalent quality and price, within the limits of available stocks.

  • Or to be reimbursed for the price of the product ordered within 30 days of its request.

 

Article 6 - Ordering methods and prices

6.1. The customer guarantees that he is fully authorized to use the payment card or his PayPal account for the payment of his order and that these means of payment provide access to sufficient funds to cover all costs resulting from the order. For payments by check or bank transfer, the order will be shipped upon receipt of payment.
 
6.2. By clicking on the button "Validate my order" during the ordering process, and after having checked in his "Basket" the contents of the order and, if necessary, to have modified it, the customer declares to accept fully and without reserve all of these General Conditions of Sale. After having confirmed the content of his order, the customer will validate it definitively by payment. The order will not be final until payment of the corresponding price. Wa-Mono will systematically confirm the order of each customer, then its shipment by email.
 
6.3. The price in Euros all taxes included for each product is indicated in the corresponding product sheet. The shipping costs of the customer's order will be indicated to him before the final validation thereof. On the order summary (sent with the order confirmation by the entrepreneur) is indicated a price including:
  • The price of the products,
  • delivery fees
Wa-Mono reserves the right to modify its prices at any time. Products and services are always invoiced on the basis of the rates in effect at the time the order is placed by the customer.
 
Tariffs : any order placed on the site and delivered outside of France may be subject to possible taxes and customs duties which are imposed when the package reaches its destination; these customs duties and any taxes related to the delivery of an item are the responsibility of the customer and are his sole responsibility.
Wa-Mono does not have the means and is not obliged to check and inform the customer of the customs duties and taxes applicable in the country where the products are delivered. (To know them, the customer must check with the competent authorities in his country).
 
6.4. Failure by the customer to comply with the obligations under the terms of these General Conditions of Sale, and in particular concerning any incident of payment of the price of an order, may result in the cancellation of the order or the refusal of future orders. Mono reserves the right to cancel an order for any reason whatsoever (anteriority of unregulated payment incidents, for example).
 
Any new order can only be made after regular payment by the customer of the sums due under previous unpaid orders.
 

 

Article 7 - Payment

Payment for purchases is made with a payment card or through a PayPal account. The payment cards accepted by the PayPal payment method to date are: CB, Visa, MasterCard, American Express, Maestro, Carte Aurore, Cofinoga, 4 stars.

  • Payment by bank card: payment is made using a bank card bearing the CB sign. The order is processed quickly, after agreement from the payment centers.

  • In case of payment by PayPal, the amount of the purchases will be immediately debited from the PayPal account. The order will be considered effective after confirmation of the agreement of the bank payment centers. In accordance with applicable regulations and to ensure the security and confidentiality of their information, Wa-Mono does not memorize the bank details of buyers. It is therefore up to the customer to save and print his payment certificate if he wishes to keep his bank details relating to his transaction.

     

    Article 8 - Security

    Online payment is made on a specific page of the site https://www.stripe.com one of the most efficient security systems available today. It not only adopted the SSL (Secure Socket Layer) encryption process, but also reinforced all scrambling and encryption processes in order to protect as effectively as possible all sensitive data related to means of payment. Wa-Mono never has access to confidential information relating to the payment method.

     

    Article 9 - Delivery of products

    9.1. Modalities
    After collection, in accordance with Article 7, Wa-Mono undertakes to proceed with delivery within:
    • 2 to 10 days for products in stock
    • for artisanal products made to order, the delivery time is variable, and will be communicated by email to the customer.
     
    9.2. Delivery method
    Deliveries are made to the address indicated in the order form which can only be in the agreed geographical area.
     
    Shipments are made by Letter Max or Colissimo and are tracked. When the order is sent, the tracking number will be sent to the buyer by email.
     
    Delivery times are only indicative; if these exceed 30 days from the order, and if payment has been made within 10 days, the sales contract may be terminated and the buyer reimbursed.
     
    The shipping costs amount to 3.50 € for shipments in France, in Letter Max followed and 7.50 € in Colissimo, and are free from 70 € of purchase for metropolitan France, Monaco and Andorra.
    For deliveries outside these areas, the shipping costs will be € 3.90 and € 9.90.
     
    9.3. Late delivery
    In such a case, the customer will make sure to contact Wa-Mono to inform them of the delay. The customer has the option of canceling his order if it has not been delivered no later than seven working days after the delivery date indicated by Wa-Mono, unless this delay in delivery is due to a force majeure within the meaning of the jurisprudence of the French Courts.
    The force majeure events are war, riot, fire, earthquake, strike, accident, inclement weather and the inability of the supplier to get supplies.
    Within 12 working days of the customer's cancellation request, Wa-Mono will request a refund from the customer with their bank or PayPal account.
     
    9.4. Loss of the package
    The package is sent by La Poste. The customer is informed by email upon the departure of the package from the Wa-Mono warehouses of the method of delivery of his order. 

    For Colissimo and LettreMax orders, the customer will also have a number to know the follow-up of his order, a number which will be communicated to him by Wa-Mono.

    It then takes 2 to 10 working days to be delivered or to receive a calling card in the letterbox. From the deposit of the transit advice note in the letterbox of the address indicated by the customer, the latter has approximately 10 days to go and collect it at the post office.

    However, if 12 working days after the shipment of the package, the customer has no news of his order, he must contact the post office closest to the place of delivery indicated on the package. If neither the Post office nor the parcel tracking (www.coliposte.net) do not indicate having any trace of this package, the customer must then contact Wa-Mono and make a declaration of loss.

    Wa-Mono will then open an investigation with the postal services. The customer will then receive an email indicating that an investigation is open. The deadlines for a definitive response from the Post Office to Wa-Mono are generally 14 working days.
    • If the package is found, it is then sent to the customer: the reception procedure then follows its normal course (deposit of the package or transit advice note, etc.)
    • If the package is declared lost, Wa-Mono will proceed with the reimbursement formalities for the order corresponding to the lost package (products and shipping costs).

       

      Article 10 - Acceptance of delivered products

      The customer must check his package on arrival and indicate all justified reservations by registered letter to Wa-Mono with acknowledgment of receipt within three working days after delivery.

      If the products delivered do not comply in kind or in quantity with the description of the order confirmation, the customer will have the possibility of exercising his right of withdrawal.

       

      Article 11 - Right of withdrawal

      11.1. Perimeter
      Legal period of the right of withdrawal
      In accordance with the legal provisions in force, you have 14 days from receipt of your products to exercise your right of withdrawal without having to justify reasons or pay a penalty.

      Conditions for exercising the right of withdrawal
      If the right of withdrawal is exercised within the aforementioned period, only the price of the product (s) purchased and the shipping costs will be reimbursed, with the return costs remaining at your expense.


      11.2. Modalities
      Returns are to be made in their original condition and complete (packaging, accessories ...), and, if possible, accompanied by a copy of the purchase invoice for optimized management.
      In the event of depreciation of the product resulting from manipulations other than those necessary to establish the nature, characteristics and proper functioning of the product, you may be held liable.

      Article 12 - Guarantees

      12.1. Legal guarantee (1641 and following of the civil code)
      Wa-Mono is bound by the guarantee for hidden defects in the item sold which make it unfit for the use for which it is intended, or which reduce this use so much that the buyer has not acquired it, or would have given a lower price, if he had known them.
      Wa-Mono, according to the customer's choice, undertakes either to reimburse the customer for the price of the product and the initial transport costs, or to exchange the customer's product for an identical product depending on the stocks available, or to exchange him a product for a product of equivalent quality and price depending on the stocks available in the event of delivery of a non-compliant product (article 4 above) and in the event of delivery of a product revealing a hidden defect.
      For any such request, the customer must then contact Wa-Mono by email and send a request by mail with acknowledgment of receipt to Wa-Mono. 
      These provisions are not exclusive of the right of withdrawal defined in Article 11 above.
       
      12.2. Contractual guarantee
      Certain products may give rise to a contractual guarantee and this will be indicated on the summary sheet of the product.
      These guarantees are clearly detailed on their summary sheet and no customer can request to benefit from a broader guarantee than the one listed. 
      In the event of a problem with a product, the customer must keep the purchase invoice sent by Wa-Mono and contact the latter.
       
      12.3. Exclusion of guarantees
      Products modified, repaired, integrated or added by the customer or any other person not authorized by the supplier of said product or service are excluded from warranty.
      The warranty does not cover apparent defects. The warranty will not cover products damaged during transport or as a result of improper use.
      Article L211-4 French Consumer Code Wa-Mono is required to deliver goods in accordance with the contract and is liable for any lack of conformity existing at the time of delivery.
      It also responds to any lack of conformity resulting from the packaging, assembly instructions or installation when it has been charged to it by the contract or has been carried out under its responsibility.
      Note: Ordinance 2005-136 2005-02-17 art. 5: The provisions of this Ordinance apply to contracts concluded after its entry into force. 
      Article L211-5 Consumer Code To comply with the contract, the goods must:
      1° - Be suitable for the use usually expected of a similar good and, where applicable: • correspond to the description given by the seller and possess the qualities that the latter has presented to the buyer in the form of a sample or model • present the qualities that a buyer can legitimately expect given the public statements made by the seller, the producer or his representative, in particular in advertising or labeling
      2° - Or have the characteristics defined by mutual agreement by the parties or be suitable for any special use sought by the buyer, brought to the attention of the seller and which the latter has accepted.
      Note: Ordinance 2005-136 2005-02-17 art. 5: The provisions of this Ordinance apply to contracts concluded after its entry into force.
      Article L211-12 Consumer Code Action resulting from lack of conformity lapses two years after delivery of the goods.
      Article 1648 paragraph 1 Civil Code The action resulting from latent defects must be brought by the purchaser within two years from the discovery of the defect.

       

      Article 13 - Personal data

      13.1  Wa-Mono undertakes to respect the confidentiality of personal data communicated by customers on the Website and to treat them in accordance with the Data Protection Act of January 6, 1978.
       
      13.2 In accordance with the Data Protection Act of January 6, 1978, Wa-Mono has made a simplified declaration and a commitment to comply with said declaration, relating to the simplified standard n ° 48, to the National Commission In

      Article 14 - Miscellaneous

      14.1 In the event that any of the terms of the General Conditions of Sale would be considered illegal or unenforceable by a court decision, the other provisions will remain in force.
      14.2 Pursuant to Articles 1316 et seq. Of the Civil Code and, where applicable, Article L.110-3 of the Commercial Code, the information provided by the Website is authentic between the parties.
      Items such as the time of reception or transmission, as well as the quality of the data received will prevail as a priority as appearing on Wa-Mono's information systems and the sales interface, or as '' authenticated by the computerized procedures of Wa-Mono and the sales interface, except to provide written proof to the contrary by the customer.
      The scope of proof of the information delivered by Wa-Mono's computer systems and the sales interface is that granted to an original in the sense of a written document on paper, signed by hand.

       

      Article 15 - Intellectual property

      Any product protected by an intellectual property right of which Wa-Mono is the holder, remains unreservedly the intellectual property of its manufacturer.

      All orders are for the personal use of the customer. The customer refrains from any partial or total resale of the products.

      Any possible reproduction, exceeding personal use, is subject to the express and prior authorization of Wa-Mono.

       

      Article 16 - Law - Liability and Litigation

      Wa-Mono cannot be held responsible for any damage that may result from the misuse of the products sold on its site. 
      Wa-Mono's liability will, in any event, be limited to the amount of the order and cannot be blamed for simple errors or omissions which may have remained despite all the precautions taken in the presentation of the products.
      These General Conditions of Sale in French will be executed and interpreted in accordance with French law.
      In the event of a dispute, the customer will contact Wa-Mono for an amicable solution. Otherwise, the French courts will be competent.
      Transfer of ownership: ownership is transferred only after full payment of the price
